First, City Council does not have the authority to file a lawsuit on behalf of the City of Atlantic City ... Second, Even if they had that authority (which they do not), City Council would have had to vote for a resolution, approving the lawsuit in public session ... They did not do so ... Third, Dan Gallagher stated that all members of City Council voted to pursue this litigation ... This is patently untrue ... Councilman William Marsh did not vote for this action to be taken ... Fourth, our investigation has yielded that Council discussed this matter (Gindhart and recouping money paid out to two employees, who claimed harassment) in Executive Session ... However, the item was not on the agenda to be discussed in Executive Session ... So, even this portion of this political stunt was improper ... These are yet more examples as to why Judge Val Armstrong was so incorrect, in her recent decision allowing City Council to retain its own solicitor ... Does Gallagher not understand the powers of the Legislative Branch? If he does understand, is he ignoring these realities in pursuit of a political agenda? ... Developing
