City Counsel already voted to settle the case acquiecing to the indemnification; Further, Joe Gindhardt NEVER consented to the settlement entered into by the City and we have confirmed that he was NOT consulted. As a result he can NOT be compelled to pay the settlement amount as that would violate his due process rights.
